Terms of Service

By using or paying for I'm Blue, Lda.'s ("FairATS") applicant tracking service, you agree to these Terms of Service ("Terms"). Any material changes will be posted on this website at least one month before they take effect. If you reject the changes, stop using the service.

This document was written in English. The English text is the only version for which FairATS can be held accountable.

• Minimum age. You must be at least 18 years old to use the service as a customer.
• Privacy. FairATS does not sell, rent, or monetize your personal data or your applicants' personal data. See the Privacy Policy.

The service

FairATS is an applicant tracking system, hosted in the EU. Your team publishes job ads, receives applications, and reviews, scores, and decides on them. Applicants get a status page for each application. FairATS does not use AI to screen, score, or rank applicants.

The plan has the limits shown on the pricing page. Emails beyond the monthly allowance are billed as shown there.

Your applicants' data

You are the controller of the personal data of your applicants, and FairATS processes it on your behalf. You are responsible for having a lawful basis to process it and for what your team writes about applicants. Applicant data is deleted after the role closes, or sooner when an applicant asks.

Payment

The plan is billed monthly, in advance. Prices exclude VAT, which is added where it applies. These Terms apply for the period you have paid for.

Refund policy

If FairATS isn't right for you, email help@fairats.com within 14 days of your first payment, and we will refund it in full. After that, you can cancel at any time, and the plan ends at the end of the month you paid for. Complaints can be sent to the same address.

Acceptable use

You will use the service only for lawful purposes and for real job openings. Unacceptable use includes, but is not limited to:

• Publishing job ads for roles that don't exist, or to collect personal data for other purposes.
• Discriminating against applicants on grounds protected by law.
• Sending spam or other unsolicited messages through the service.
• Attacking or disrupting the service or other systems.
• Publishing content that infringes the rights of others, or that insults or demeans people or groups of people.

If we learn of unacceptable use, we may ask you to stop, and we may suspend or end your access to the service.

Disclaimers

We may change the service by updating the software or the features. We try to avoid interruptions and defects, and we do not guarantee that the service or this website will always be available or accurate. The service is provided "as is" and "as available." Hiring decisions are yours.

Exclusions. To the full extent permitted by law, we exclude all express or implied warranties, including merchantability, fitness for a particular purpose, non-infringement, and freedom from harmful code.

Limitation of liability. FairATS is not liable for any lost profits or consequential, special, punitive, indirect, or incidental damages arising out of or in connection with these Terms or the service.

Applicable law and venue

These Terms are governed by the laws of Portugal. Any dispute arising from them or from the service shall be resolved in the courts of Porto, Portugal, and you submit to the personal jurisdiction of those courts. Consumers may also use any applicable out-of-court dispute resolution mechanisms.

Termination

You may cancel at any time. We delete your account's data 30 days after the plan ends. We may modify, suspend, or end your access at any time, with or without reason.
