Privacy Policy

This Privacy Policy explains how I'm Blue, Lda. ("FairATS") processes personal information when you visit our website, contact us, use FairATS as a customer, or apply for a job through FairATS (the "Services").

This document was written in English. The English text is the only version for which FairATS can be held accountable.

We collect little, keep it in the EU, and do not sell it. The General Data Protection Regulation ("GDPR") and other applicable data protection laws apply.

If you apply for a job through FairATS

The company you apply to is the controller of your application data, and FairATS processes it on their behalf. To use your rights, contact that company; you can also write to us and we will pass your request on.

Your application, and what the hiring team writes about it, is deleted after the role closes. You can ask for it to be deleted sooner.

Purpose and legal basis for each processing

Customer accounts. We process the names and email addresses of your team to run your account. This is necessary to perform our contract with you.

Applications. We process applications on behalf of our customers, under a data processing agreement, to provide the service.

Payments. Payment information is processed to provide the service, to handle refunds, and for accounting. Processing for accounting is necessary to comply with legal obligations, including Portuguese accounting and tax law.

Enquiries and support. Emails you send us are processed to answer you. This is based on our legitimate interest in helping you.

How long is the personal data saved?

Customer accounts. Kept while the account exists, and deleted 30 days after the plan ends.

Applications. Deleted after the role closes, or sooner on request.

Payment data. We keep accounting records for as long as Portuguese law requires. After that, they are deleted.

Enquiries and support. Messages and contact details are deleted when the request is resolved, unless you become a customer.

Third-party recipients

We share personal data only with third parties that perform services for us, for the purposes above: a payment provider, and infrastructure providers that run the service in the EU. They are bound by contract and confidentiality.

Legal disclosure. We may share data when the law requires it: to comply with law, regulation, legal process, or a government request; to enforce our Terms; to detect or address fraud, security, or technical problems; or to protect the rights, property, or safety of FairATS, our users, or the public, as required or permitted by law.

Is any transfer made to a third country?

No. We store and process personal data in the EU/EEA.

Rights of individuals

You have the right, in certain situations, to request access to, correction or deletion of your personal data, restriction of processing, and (where applicable) data portability. Where the legal basis is legitimate interest, you may object at any time.

You may lodge a complaint with a supervisory authority. In Portugal, that is the Comissão Nacional de Proteção de Dados (CNPD), www.cnpd.pt. To exercise your rights, email help@fairats.com.

Updates

We may update this policy. The new version will be published on this page. If you keep using the Services after a change, that is acceptance of the updated policy.
